Από το δικαστήριο διατάσσονται και τα προληπτικά μέτρα του άρθρου 10 του Π.Κ. δηλαδή η απαγόρευση λήψης ασφαλιστικών μέτρων ή αναγκαστικής ή συλλογικής εκτέλεσης κατά του οφειλέτη, ώστε να αποτραπεί η επιδείνωση της οικονομικής του θέσης. Τα προληπτικά μέτρα ισχύουν από την κατάθεση της αίτησης για το άνοιγμα της διαδικασίας εξυγίανσης και μέχρι τη λήξη της. Η χορήγηση της αναστολής επάγεται αυτοδικαίως την απαγόρευση της διάθεσης των ακινήτων και του εξοπλισμού της επιχείρησης του οφειλέτη. Επισημαίνεται ότι η αναστολή μπορεί να καταλαμβάνει και την περιουσία των εγγυητών του οφειλέτη.
