Σε μία τέτοια περίπτωση ο ΠΩΛΗΤΗΣ,

Σε μία τέτοια περίπτωση ο ΠΩΛΗΤΗΣ, θα δύναται, κατά την απόλυτη διακριτική του ευχέρεια, είτε α) να αξιώσει την καταβολή του συνολικού υπολειπομένου τιμήματος, είτε β) να θεωρήσει την παρούσα ως προς την πώληση των εκ των Πωλουμένων Μετοχών που αναλογούν στο κατά τα άνω υπολειπόμενο τίμημα («Ανεξόφλητες Μετοχές») ως τελούσα υπό τη διαλυτική αίρεση της ολοσχερούς εξόφλησης αυτού και την εν λόγω αίρεση ως πληρωθείσα, με αποτέλεσμα να ανατραπεί η ως άνω πώληση και μεταβίβαση των Ανεξόφλητων Μετοχών, να χαθεί κάθε αποκτημένο στο μεταξύ δικαί¬ωμα του ΑΓΟΡΑΣΤΗ και να επιστρέψει αυτόματα και αυτοδίκαια η κυριότητα, νομή και κατοχή των εν λόγω μετοχών στον ΠΩΛΗΤΗ, είτε τέλος γ) να θεωρήσει την κατά τα άνω διαλυτική αίρεση πληρωθείσα ως προς την πώληση μερικών μόνο εκ των Ανεξόφλητων Μετοχών με αποτέλεσμα να ανατραπεί η πώληση και μεταβίβαση μόνο των εν λόγω μετοχών και να αξιώσει την καταβολή του υπολειπομένου τιμήματος
