Μετά την κατάθεση των δηλώσεων κόστ

Μετά την κατάθεση των δηλώσεων κόστους και παραδοτέων, ξεκίνησε η φάση διευκρινήσεων και διαπραγματεύσεων της E.Ε. με την εκάστοτε χώρα/ συμμετέχουσα καθώς και με την Ελλάδα/ ΤΕΟ Α.Ε. Πιο συγκεκριμένα για την δήλωση κόστους της ΤΕΟ Α.Ε. ακολουθήθηκε η παρακάτω διαδικασία:
Με ηλεκτρονικό ταχυδρομείο 11/01/2014, η ΤΕΟ Α.Ε. έλαβε επιστολή από την Ε.C/ TENTEA, η οποία της ζητούσε πλήθος στοιχείων για επιλεγμένα τιμολόγια έργων, συνολικού ύψους: 1.181.208,68 Ευρώ.
Σε αυτό το αίτημα η ΤΕΟ Α.Ε. απάντησε με το σύνολο των εγγράφων που της ζητήθηκαν (Λίστα επιλεγμένων τιμολογίων, τιμολόγια, αναφορές), με ηλεκτρονική απάντηση και αποστολή όλων των στοιχείων, 11/02/2014.
Τέλος η E.Ε. επανήλθε με διευκρινιστικό ερώτημα 26/02/2014, όπου ζητούσε λεπτομερείς διευκρινίσεις για κάθε ένα επιλεγμένο τιμολόγιο- έργο ξεχωριστά. Με βάση την σχετική σύμβαση, το περιθώριο αποστολής της απάντησης, είναι δύο μήνες, με καταληκτική ημερομηνία 26/04/2014.
Η ΤΕΟ Α.Ε. με τον Ν. 4250/2014, ΦΕΚ Α'74/26-03-20104 καταργήθηκε και όλες οι αρμοδιότητες και υποχρεώσεις των διεθνών σχέσεων μεταβιβάστηκαν στην Εγνατία Οδό Α.Ε..
Όπως ορίζεται από τις διαδικασίες της E.E. , η μη απάντηση στα ζητούμενα της φάση της διαπραγμάτευσης, θεωρείται αρνητική και ακολουθεί η λήψη απόφασης για την διαδικασία επιλεγμένων τιμολογίων με βάση τα υπάρχοντα δεδομένα.
Εν συνεχεία όπως η Ε.Ε. απέστειλε των κατάλογο με τα απορριπτέα στοιχεία - τιμολόγια και ζήτησε την αποστολή νέας δήλωσης κόστους με βάση της διαδικασίες της Ε.Ε..
Σε απάντηση του Σχετικού 3 , σας ενημερώνουμε ότι:
Όλα τα τιμολόγια που αναφέρονται , έχουν ήδη αποσταλεί στην Ε.Ε. (11/01/2014).
Η αποστολή των στοιχείων για τα "studies" δεν ήταν λανθασμένη. Σε όλα τα Ευρωπαϊκά προγράμματα στην περίοδο εργασίας συνυπολογίζετε το κόστος εργασιών για το κλείσιμο του εκάστοτε προγράμματος και είναι στην διακριτική ευχέρεια του διαπραγματευτή να τα διεκδικήσει από την Ε.Ε.
Στην παρούσα φάση η ΤΕΟ Α.Ε. είναι υπό εκκαθάριση φορέας και δύναται να παρέχει υποστηρικτικό ρόλο στην Εγνατία οδό Α.Ε., στο τομέα των διεθνών σχέσεων και για όσο διάστημα διαρκέσει η εκκαθάριση, με πρόσβαση στο αρχείο και ενημέρωση για ενέργειες οι οποίες έγιναν μέχρι 26/03/2014.
Τέλος και μετά την προφορική συνεννόηση όλων των εμπλεκόμενων φορέων ζητήθηκε παράταση για την επανεκκίνηση των διαπραγματεύσεων. Η παράταση που δόθηκε από την Ε.Ε. ορίσθηκε μέχρι 09/09/2014.
Με το παρόν τονίζουμε τα παρακάτω βασικά σημεία τα οποία θα πρέπει να αναφέρονται στην επιστολή προς την Ε.Ε.:
Αίτημα παραμονής σε ισχύ της δήλωσης κόστους της ΤΕΟ Α.Ε. / Ελλάδας(4.711.902,08 Ευρώ.), που έχει αποσταλεί 31/12/2013.
Αίτημα παραμονής και απόδειξης, της λίστας επιλεγμένων τιμολογίων 11/01/2014.
Αίτημα απάντησης και αποστολή μερικών διευκρινήσεων στο από 26/02/2014, αίτημα της Ε.Ε.
Λόγω της υπάρχουσας αδυναμίας της υπό εκκαθάρισης ΤΕΟ Α.Ε. έχει ξεκινήσει διαδικασία για πρόσβαση στο ηλεκτρονικό αρχείο και για πρόσληψη προσωπικού που θα εργαστεί και για την ανεύρεση των στοιχείων. Το σχετικό σχέδιο νόμου βαίνει προς ψήφιση, προκειμένου να δώσει την δυνατότητα πλήρους πρόσβασης στα αρχεία και την πρόσληψη κατάλληλου υποστηρικτικού προσωπικού, προκειμένου η υπό εκκαθάριση ΤΕΟ Α.Ε. να παρέχει την πλήρη υποστήριξη στις διευκρινίσεις που χρειάζονται από την Εγνατία Οδό Α.Ε. και την Ε.Ε. Η εκτιμώμενη περίοδος για την ψήφιση του νομοσχεδίου από την ελληνική Βουλή, είναι ένας μήνας.
Για την παροχή των υπόλοιπων διευκρινήσεων της, από 26/02/2014 επιστολής της Ε.Ε., που αναφέρονται στην παροχή πληροφοριών:
