Πολύ δε περισσότερο ισχύον τα ανωτέρω σχετικά με τις συμφωνίες τις εταιρείας μας με την «MEDTRONIC HELLAS S.A.» σχετικά με την συμμετοχή μας στους διαγωνισμούς Ε.Π.Υ. 08/2010 για την προμήθεια προϊόντων αγγειοπλαστικής, στον οποίο η εταιρεία μας συμμετείχε κοινοπρακτικά με την «MEDTRONIC HELLAS S.A.» δυνάμει του από 02-9-2010 Ιδιωτικού Συμφωνητικού, και Ε.Π.Υ. 02/2010, στον οποίο η εταιρεία μας συμμετείχε τυπικά μεν η ίδια, κατ’ ουσίαν όμως με κυρίαρχη εμπλοκή της «MEDTRONIC HELLAS S.A.» σε όλα τα στάδια του διαγωνισμού (προμήθεια προϊόντων, καθορισμός τιμών, παροχή τεχνικής υποστήριξης κλπ), ώστε και εν προκειμένω η συμμετοχή στον διαγωνισμό να είναι κατ’ ουσίαν κοινοπρακτική, τουλάχιστον στο πλαίσιο της εσωτερικής μεταξύ μας σχέσεως – μολονότι ακόμη και η ΕΠΥ τελούσε εν γνώσει της συνεργασίας. Οι άνω δύο συμφωνίες, ανεξαρτήτως της τυπικής τους υπόστασης, ουσιαστικά αποτελούν συμφωνίες προσανατολισμένες σε συγκεκριμένο έργο και η ισχύς τους περατούται με την ολοκλήρωση του έργου (προμήθεια των δημοσίων νοσοκομείων) και όχι με την πάροδο συγκεκριμένου χρόνου, καθώς δεν προβλέπουν συγκεκριμένο χρονικό σημείο λήξεως, αλλά έχουν άδηλο χρονικό ορίζοντα, εξαρτώμενο πρακτικά από τον χρόνο έναρξης της προμήθειας των δημοσίων νοσοκομείων μέσω των διαγωνισμών. Και στις δύο περιπτώσεις οι συμβάσεις για την προμήθεια των νοσοκομείων μέσω των Κεντρικών Διαγωνισμών υπεγράφησαν εντός του έτους 2012, με ικανή καθυστέρηση από την διενέργειά τους.

The above two agreements, irrespective of their formal status, essentially are oriented to specific project agreements and their validity shall be terminated upon completion of the project (supply of public hospitals) and not over this time, as it does not provide for specific point of termination, but have uncertain time horizon, dependent practically from the start time of the supply of public hospitals through competitions. In both cases the contracts for the supply of hospitals through the Central Contracts were signed in the year 2012, with likely delay by carried out.
