Proportionate application of the provisions of P.D. 219/1991 (and indirectly of Directive 86/653/EEC of the Council of the European communities) and the exclusive distributorsThe Presidential Decree 219/1991 on commercial agents "was aimed at adaptation of Greek legislation with the provisions of Directive 86/653/EEC of the Council of the European Communities ' for the coordination of the laws of the Member States relating to self-employed commercial agents". The provisions of PRESIDENTIAL DECREE 219/1991 apply to exclusive distributors, in accordance with article 14(1). 4 of law 3557/2007 (FEK a 100/14 May 2007) stipulates that "the provisions of p.d. 219/1991, as applicable, shall apply mutatis mutandis to contracts of ... (b) exclusive distribution), where, as a result of this contract, the Distributor acts as part of the commercial organisation of vendor ... ". The legislature complied with the view that prevailed in the jurisprudence: the Areopagus, starting with the No. 139/2006 decision, had held explicitly that the provisions of PRESIDENTIAL DECREE 219/91 on compensation to customers of a commercial agent of goods applied proportionately first cheque of the principle of equality and the exclusive distribution, where she works as the commercial delegation. A similar solution was given shortly afterwards by the Swiss Court of Cassation (judgment No. 4A-61/22.5.2008).
